Terms of Service & Privacy Policy

1. Acceptance of Terms

YOUR USE OF DYNAMICCOUPONS IS EXPRESSLY CONDITIONED UPON YOUR ACCEPTANCE OF THESE TERMS. Use of the Site constitutes your unconditional agreement to be bound by this Agreement. If you do not agree, you must immediately cease using this Site. You must be at least 18 years of age to create an account or publish content.

2. Automated Content Moderation & AI Safety

To maintain a "Family-Friendly" environment, DynamicCoupons utilizes AI, Optical Character Recognition (OCR), and a Built-in Word Rejection Engine.

• Real-Time Rejection: Content containing restricted keywords or inappropriate imagery will be flagged and rejected instantly upon submission or during automated review.
• Liability Waiver: DynamicCoupons is not liable for "false positives," posting delays, or business losses resulting from automated moderation decisions, review queues, or safety filters.

3. Merchant Fees & "No-Refund" Policy

• Final Sale: Once Content is approved and published, the Service Fee is captured and is strictly non-refundable.
• Subscription & Features: Fees for Subscription Credits or Premium Features (e.g., Email Captures) are considered services rendered upon activation and are strictly non-refundable.

4. Merchant Obligations, Content Rights & Redemption Rules

• Redemption Caps & Honoring Offers: Merchants are solely responsible for setting their own "Redemption Cap" and circulation limits. Merchants explicitly agree upon listing to honor all valid redemptions generated during the coupon's active publication period.
• Manual Deletion: Merchants may delete an offer at any time. Upon deletion, the offer is removed from maps and permanently purged from the active database. Manual deletion does not entitle the Merchant to a refund or credit.
• Merchant Intellectual Property Warranty: Merchants represent and warrant that they hold all legal rights, licenses, and permissions for all uploaded logos, trademarks, text, graphics, and images. Merchants agree to fully indemnify and hold harmless DynamicCoupons from any third-party copyright or trademark claims arising from their content.

5. Intellectual Property & Copyright

The Site, including its "look and feel," brand name, logos, Real-Time Data Collection architecture, business processes, patent-pending frameworks, and underlying software, is protected by U.S. and International Copyright and Intellectual Property laws. You may not modify, reverse engineer, scrape, duplicate, or distribute any portion of the Site's design or layout without express written permission.

6. Prohibited Users, Security & Platform Integrity

You are strictly prohibited from accessing the site if you are attempting to violate its security. This includes using IP masking (VPNs to bypass geolocation boundaries), using automated robots or scrapers to harvest data, circumventing automated moderation tools, or running browser extensions or scripts that alter DynamicCoupons data or architecture.

7. Privacy & Personal Information (The "No-Sell" Promise)

DynamicCoupons does not sell or rent user personal information to third parties for marketing purposes. We collect names, emails, and IP addresses solely to service your account, enable redemption features, and enforce platform safety. We may release information if legally compelled to do so to protect the safety, rights, or property of our community and platform.

8. Security & Encryption

We use industry-standard Secure Sockets Layer (SSL) encryption for all personal information collection. Our data centers utilize redundant firewalls, access controls, and database encryption.

9. Email Capture, CAN-SPAM & Data Responsibility

• Compliance Responsibility: Merchants utilizing the optional 'Email Capture' feature must strictly comply with all applicable privacy laws, including CAN-SPAM and local opt-out requirements. Users redeeming coupons explicitly consent to receive merchant promotional communications.
• Automatic Data Purge: WARNING: Captured email listings are automatically and permanently deleted immediately upon coupon expiration. Merchants are solely responsible for exporting, downloading, and securing this data prior to offer expiration. DynamicCoupons assumes no liability for lost data.

10. Referral Program & Privacy

Referral IDs are system-generated random characters to protect user identity. Participants receiving referral compensation must clearly disclose their affiliate relationship with DynamicCoupons as required by FTC guidelines.

11. Referral Program Eligibility, Verification & Anti-Fraud Policy

To comply with financial regulations, safeguard ecosystem integrity, and ensure fair community practices, all referral wallet payouts are subject to strict identity, entity, and transaction verification prior to fund disbursement.

• Eligible Entities: Referral codes and Wallet payouts are strictly reserved for verified non-profits, trade associations, student ambassadors, and authorized community partners.
• Verification Requirements: Prior to initial payout release (or for payout requests reaching the $50 minimum threshold), DynamicCoupons reserves the right to request proof of legal entity status (such as a State Business Registration, IRS 501(c)(3) determination letter, active website, or authorized officer identification).
• Anti-Fraud & Forfeiture: Self-referrals, fake accounts, structured artificial transactions, and unverified duplicate accounts are strictly prohibited. Attempted system manipulation will result in immediate wallet balance forfeiture, account termination, and potential legal action.

12. Relationship of Parties & Disclaimers of Service

DynamicCoupons is an advertising technology facilitator only. The legal relationship and contract for any commercial transaction exist solely between the Merchant and the Customer.

• Merchant Discretion: All offers are subject to the Merchant's discretion. The Merchant reserves the right to manage storefront service as permitted by applicable law.
• Non-Liability for Merchant Fulfillment: DynamicCoupons is not responsible or legally liable for any Merchant’s refusal or inability to honor a coupon, refusal of service, or the quality, safety, legality, or availability of the underlying items or services offered.
• Due Diligence: Users and Shoppers are expected to perform their own research and due diligence before interacting, redeeming, or transacting with merchants on the platform.

13. Limitation of Liability, Force Majeure & Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. DynamicCoupons expressly disclaims all warranties of any kind, whether express or implied. DynamicCoupons is not liable for service interruptions or damages caused by events beyond its reasonable control (including natural disasters, telecommunication failures, server downtime, or third-party disruptions) or for incidental, indirect, or consequential damages resulting from your use of or inability to use the platform. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.

14. Governing Law & Binding Arbitration

This Agreement is governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law principles. Any controversy, claim, or legal dispute arising out of or relating to these Terms or the platform shall be settled exclusively by binding individual arbitration conducted in Reno, Nevada. You waive any right to participate in class-action lawsuits or class-wide arbitration proceedings.
